Facts of the case
Firstly, to discuss the fact of the case, this is to state that counter-defendant of the case OpenPeak Inc. has entered into acontract with Counter-plaintiff, Option Wireless, Ltd. According to this contract, the counter-defendant was required to sell12300 tablet units of particular modules in consideration of $848,700.00.
Counter-defendant (seller) has sent part of theorder to counter the plaintiff and it was decided between the parties to send part of the assignment later on. Counterplaintiff found default in the provided goods and considered it as a breach of contract (Cases.justia.com, 2019).
The counter-defendant rejected this claim stating that purchasing order should not be treated as a controlling contract and therefore thecounter plaintiff was not entitled to seek consequential damages. These claims further lead to disputes between the parties.
Parties and their position
OpenPeak Inc., the seller of tablets was in a position of counter-defendant whereas, on the other side, Option Wireless, Ltd,the purchaser of tablets was counter plaintiff for the case.
