I.Introduction

In a previous antitrust case, Boston Scientific Corp. v. Dongchul Lee, No, 13-131561DJC,2014 WL 1946687, Dr. Lee broke his confidentiality agreement and took confidential information to his new employer. In the case of Boston Scientific Corp, Dr. Lee signed a confidentiality agreement.

Like Dr. Lee, Ms. Lawson broke her confidentiality agree as well. Ms. Lawson took a draft letter intended for the Greene’s patent lawyer.

The letter contains details of the secret process for creating Ever-Gold. Ms. Lawson took the letter to one of Greene’s competitors, Howell’s Jewelry World, using the information as a negotiation tool to get hired on by Howell.I also reviewed the counter suit that Ms. Lawson has against our client for wrongful termination.

Upon further research the following case, Carbonara vs. Bank of New York Mellon Corporation has the same legal precedent. Ms. Carbonara was suing her employer, Bank of New York Mellon Corporation, for wrongful termination because she was pregnant.

Bank of New York Mellon Corporation was restructuring their organization. The bank didn’t lay her off because she was pregnant, she was terminated due to restructuring.

Like our client, the bank did know that Ms. Carbonara was pregnant, they eliminated the position Ms. Carbonara held. In this case, the ruling was in favor of the bank due to the restructuring. I feel that our client, like the Bank of New York Mellon, has a great chance to win the counter suit.

In this memo, I have gathered information in which we can conclude gives our firm a high probability of winning both cases for our client.

II.Client Casea.

Fact and Laws

i.New Hampshire is an at-will state. According to the National Conference of State Legislatures, At-will means that an employer can terminate an employee at any time for any reason, except an illegal one, or for no reason without incurring legal liability.

Likewise, an employee is free to leave a job at any time for any or no reason with no adverse legal consequences (2017). Our client was downsizing the research and development department; they had the right to terminate Ms. Lawson position based on the downsizing of her department.

Lisa Peele, head of human resources, informed Ms. Lawson about the downsizing.
