McDonald’s coffee was served at a temperature between 180 and 190 degrees.
Prior to this case, there were more than 700 cases of people being scalded by McDonald’s hot coffee.
Mrs. Liebeck was not driving when she suffered the third degree burns across her groin, thighs, genitalia and buttocks.
Mrs. Liebeck spent seven days in the hospital and three weeks at home to recover from the burns.
McDonald’s Quality Control manager testified that McDonald’s knew of the risk of “dangerously” hot coffee.
McDonald’s refused to raise its compensation offer above $800.
Months after the trial, the judge reduced the jury’s punitive damages award of $2.7 million to $640,000.
There has been several other cases of third degree burns following Mrs. Liebeck’s case.
ASSUMED FACTS
Plaintiff intentionally ordered a hot, freshly brewed coffee
Plaintiff knowingly assumed the risk of spilling liquid on herself when:Placing it on an uneven surface without a stable way to secure the coffee cup.
Removing the lid soon after receiving the hot coffee.
Plaintiff was wearing pants made of a thin material that led to her experiencing more severe burns than she would have experienced if she had been wearing pants made of a thicker, more durable material.
The grandson, who was driving the car, did not:
Secure the vehicle in a location away from the ‘drive-thru’
Assist his grandmother with finding an even surface on which to place her cup, or securing the cup
KEY LEGAL ELEMENTS
In order to submit a strong negligence claim as a plaintiff, “the plaintiff must meet each of the following requirements: duty, breach of duty, causation and injury” (McAdams, 2015).
Definitions for the different requirements:
Duty:The defendant owed a legal duty to the plaintiff under the circumstances.
Breach: The defendant breached that legal duty by acting or failing to act in a certain way.
Causation: It was the defendant’s actions (or inaction) that actually caused the plaintiff’s injury.
Injury:The plaintiff was harmed or injured as a result of the defendant’s actions (McAdams, 2015).
Duty: McDonald’s gave a warning to each and everyone of its customers regarding the temperature of the coffee.
Breach of Duty: McDonald’s required all of its employees in every branch to serve coffee at 180-190 degrees Fahrenheit through Corporate Specifications.
Employees performed their duty as required. McDonald’s did not encourage their employees to intentionally hurt customers.
