I.Memo Introduction:

The Strength of Greene’s legal claim lies in the fact that Jennifer signed a confidentiality agreement at the beginning of her employment.

By signing this agreement Jennifer agreed to not divulge any information regarding Greene’s process to create Ever-Gold. Jennifer’s history of tardiness is also reasonable grounds for termination.

II. Client’s CaseA.

Facts and Laws

1.Greene’s Jewelry without notice eliminated the jobs of all junior executive secretaries. Prior to this, Jennifer Lawson was an employee for several years and received high marks during her annual reviews. The only negative marks she received were due to recurrent tardiness.

Jennifer Lawson learned she was pregnant and that she would have to take some time off due to high risk factors. When Ms. Lawson notified the head of human resources she was told that her position had been eliminated due to downsizing. Ms. Lawson was subsequently terminated from her job.

2.Upon hiring Ms. Lawson, Greene’s Jewelry required that she sign the confidentiality agreement. Shortly after she was terminated, Ms. Lawson was hired by a competitor, Howell Jewelry World. Before being hired by Howell Jewelry World, she deliberately released to Howell classified information outlining the process used by Greene’s to make Ever-Gold.
