Reason for Referral Mr. B was referred by the courts for a mental health evaluation to assist in determining his eligibility for Parole, and also to determine if it is appropriate for Mr. B to have visitations with his son Albert. Due to Mr. B’s current incarceration of kidnapping of his ex-wife Jamie, and physical violence towards his son. This assessment will determine if visitations would be appropriate, as both Jamie and Albert would be present at any court ordered visitations.FRE 702 Overview The Federal Rule of Evidence 702 (FRE 702) outlines what constitutes the qualifications of an expert testimony. According to the Legal Information Institute (n.d), FRE 702 is a testimony given by an expert witness who has the skills/experience, training, and/or education that qualifies them as an expert. Experts asked to testify will be considered based on the following: the expert’s scientific, technical or specialized knowledge, which will assist the court to understand the evidence and/or determine a fact in question; sufficient facts and data are used to develop the testimony; reliable applications of the principles and methods to the case facts by the expert (LII, n.d). The American Psychological Association (2020), also states that the expert on the case must have an overall understanding regarding the legal/professional laws and standards, laws, and rules, per standard 2.04.

Additionally, continuous efforts must be made to develop as well as maintain competency (APA, 2020). An expert witness and/or evaluator must meet the qualifications outlined by the FRE 702to ensure their testimony is reliable and valid. An expert witness testimony must also meet the Daubert Standard requirements. The Daubert Standard is used to determine if the testimony is based on scientific reasoning that is applicable to the facts of the case (LII, n.d). According to the Legal Information Institute (n.d), there are five factors when determining the validity of a methodology: the theory and/or technique can, or has been tested; peer reviewed and publication;known and/or potential error rate; existence of maintenance standards that control operation;acceptance within the scientific community.FRE 702 Qualifications As it relates to his formal education, Dr. George Turner has completed relevant,specialized casework that is applicable to this present case. While obtaining a master’s degree in psychology from Southern New Hampshire University, coursework was completed in graduate research methods, forensic psychology, measurement and assessment, assessment in forensic psychology, ethical practice, theories of personality and cognitive psychology.
