According to Legal Information Institute (n.d.), FRE 702 is a testimony given by an expert witness and has the following, skills/experiences, training and/or education,qualifying them as an expert.Testifying experts will be considered based upon the following:the expert’s knowledge (i.e. scientific, technical, specialized), which will assist the trier to understand the evidence and/or to determine a fact in question; sufficient facts/data are used to develop the testimony; reliable applications of the principles/methods to the case facts by the expert (LII, n.d). According to the American Psychological Association (2020), the expert on the case must have an overall understanding regarding the legal/professional laws/standards, laws,and rules, per standard 2.04. As mentioned above, an expert witness/evaluator must meet the qualifications outlined by the FRE 702 to ensure their testimony is valid/reliable.

While expert testimonies must meet the FRE 702, it must also meet the Daubert standard requirements. This standard is used to determine if the testimony is based on scientific reasoning that is applicable to the facts of the case (LII, n.d.). According to Legal Information Institute (n.d.), there are five factors when determining the validity of a methodology and they are the following: the theory/technique can/has been tested; peer reviewed and publication; known/potential error rate;existence/maintenance of standards that control operation; acceptance within the scientific community. The evaluator for this case obtained her Doctor of Psychology (Psy D) from The Chicago School of Professional Psychology and completed a postdoctoral internship of 2,000hours. Upon completion of the internship, the evaluator obtain license in the state of Georgia.
